Copyright, which applies to works of the mind (writings, paintings, drawings, photos, videos, etc.), gives the author exclusive property rights over her creation, both in terms of moral rights (disclosure, for example) and economic rights (right to use the work: representation, reproduction or adaptation).
Copyright applies from the moment the work is created. In the event of infringement of copyright, reproduction, representation or distribution without the author’s consent, the author may bring an action for infringement under civil or criminal law (Intellectual Property Code, Articles L335-1 to L335-10).
The author has the exclusive right to authorise or prohibit the reproduction of his or her work. According to the Intellectual Property Code, reproduction consists of ‘the physical fixation of the work by any process that enables it to be communicated to the public indirectly’ (article L122-3). The reproduction of a painting in a book, the production of copies of a sculpture, the printing of a photograph of an architectural work or the printing of a drawing on a T-shirt, etc. must therefore be authorised by the author under the reproduction right, even if the work is only partially reproduced (article L122-4).
Works presented on https://hortense-art.com/ are protected by the laws on Literary and Artistic Property. Counterfeiting is punishable by three years’ imprisonment and a fine of 300,000 euros. This website constitutes a work protected in France by the Intellectual Property Code, and abroad by the international copyright conventions in force.

Le droit d’auteur, qui porte sur les œuvres de l’esprit (écrits, peintures, dessins, photos, vidéos etc.), confère à l’auteure un droit de propriété exclusif sur sa création, aussi bien en matière de droits moraux (divulgation, par exemple) que patrimoniaux (droit d’exploitation de l’œuvre : représentation, reproduction ou adaptation).
Le droit d’auteur s’applique dès la naissance de l’œuvre. En cas d’atteintes au droit d’auteur, de reproduction, représentation ou de diffusion sans l’accord de l’auteur, celui-ci peut intenter une action en contrefaçon au civil ou au pénal (Code de la propriété intellectuelle articles L335-1 à L335-10).
L’autrice profite du droit exclusif d’autoriser ou d’interdire la reproduction de son œuvre. La reproduction consiste, selon le code de la propriété intellectuelle, en « la fixation matérielle de l’œuvre par tous procédés qui permettent de la communiquer au public d’une manière indirecte » (article L122-3). La reproduction d’un tableau dans un livre, la fabrication d’exemplaires d’une sculpture, le tirage d’une photographie d’œuvre architecturale ou l’impression d’un dessin sur un t-shirt etc. doivent ainsi être autorisés par l’auteur au titre du droit de reproduction, même si l’œuvre n’est reproduite que de manière partielle (article L122-4).
Les œuvres présentées sur https://hortense-art.com/ sont protégées par les lois sur la Propriété Littéraire et Artistique. La contrefaçon est punie de trois ans d’emprisonnement et de 300 000 euros d’amende. Ce site web constitue une œuvre protégée en France par le code de la propriété intellectuelle, et à l’étranger par les conventions internationales en vigueur sur le droit d’auteur.
